The General Data Protection Regulation goes into effect this month on May 25. Better known as the GDPR, the regulation was adopted in 2016 to extend data protection and privacy people within the EU. If you do business within the EU, even if your company is based outside of it, the GDPR is set to affect you. While uniformity should, theoretically, make compliance easier, penalties are set at 4% of global turnover or €20 million, whichever is higher. That’s not even including the cost of litigation or compensating victims of a data breach.

Bonner v. Point72 Asset Management, 18-cv-01233, U.S. District Court, Southern District of New York. The lawsuit filed earlier this month alleges that Steven Cohen’s Point72 Asset Management firm discriminates against women. For its part, the firm denied the allegations and filed papers to seal the complaint, alleging that the claimant is trying “to harm Point72’s repetitional interests, cause upset among its employees by disclosing their confidential personal information, and perhaps, generate publicity."

Most Money Management Firms purchase blended D&O and E&O Insurance Policies under the assumption that they are covered in the event an outside shareholder brings a lawsuit alleging mis-management or breach of fiduciary. While they may be right, there are a variety of policy provisions that could preclude coverage in the event of litigation.
