Employers can be held liable for the activities of employees under the common law doctrine of agency – respondeat superior. This doctrine states that the superior (or “principal”) is held responsible for the acts of its subordinate (or “agent”). A company (the “principal” in this case) can be held liable for the actions of its employees and others deemed agents of the company, even if the agents are acting independently. This is called “vicarious liability.”

We had to know that this was coming. Due diligence guidelines and responsibilities of Advisers and Funds that make investments in other funds have been increasing steadily over the past 24 months. I don't think this is any surprise and it will be interesting to see what (if any) regulations or rules are passed as a result. See 9-12-10 Wall Street Journal article for more detail.

This happens more than we know. Read the multitude of disclaimers on your ticket and one would think we enter the stadium at our own risk. It will be interesting to see how this pans out. Interestingly the NY Jets were not named in the suit and it was there unruly fans that did the damage. Stay tuned.
